Brightenova OÜ (registration code 16859820 ), registered address Läänemere tee 17, Lasnamäe district, 13914 Tallinn, Harju county, Estonia, is the owner of Brightenova.com e-shop (hereinafter E-shop).

VALIDITY OF THE SALES AGREEMENT, PRODUCT AND PRICE INFORMATION

The terms of sale apply to the purchase of goods from the e-shop. The prices of the products sold in the e-shop are indicated next to the products.
The price includes a fee for delivering the goods. The fee for delivering the goods depends on the location of the buyer and the method of delivery. The delivery fee is displayed to the buyer when completing the order.
Information about the product is provided in the E-shop directly next to the product.

ORDER FORMATION

To order the goods, you must add the desired products to the shopping cart. To complete the order, you must fill in the required data fields and choose the appropriate method of product delivery. The amount of the fee is then displayed on the screen, which can be paid via a bank link or using another payment solution. Payments are mediated by Paysera.
The contract enters into force from the receipt of the amount to be paid to the current account of the E-shop.
If the ordered goods cannot be delivered due to the end of the goods or for some other reason, the buyer will be informed of this as soon as possible and the money paid (including the costs of delivering the goods) will be returned, generally within 1-2 working days. Depending on the payment method, it may take up to 7 working days to arrive.

DELIVERY

The shipping costs of the goods are borne by the buyer, and the corresponding price information is displayed next to the shipping method. If the E-shop has informed the buyer about delivery problems and a deadline exceeding 30 calendar days on the website or in the order confirmation, the deadline published by the E-shop applies.

RIGHT OF WITHDRAWAL

After receiving the order, the buyer has the right to withdraw from the contract concluded in the e-shop within 14 days. The right of withdrawal does not apply if the buyer is a legal entity.
In order to use the 14-day right of return, the ordered goods must not be used in any other way than is necessary to make sure of the nature, characteristics and functioning of the goods in a way that is allowed to test the goods in a physical store. If the goods have been used for purposes other than what is necessary to verify the nature, characteristics and functioning of the goods, or if they show signs of use or wear, the Online Store has the right to reduce the refundable fee according to the decrease in the value of the goods.
In order to return the goods , a statement of withdrawal from the purchase of the goods must be submitted and send it to the e-mail address info@brightenova.ee within 14 days of receiving the goods at the latest.
The cost of returning the goods is borne by the buyer, unless the reason for the return is that the thing to be returned does not correspond to what was ordered (e.g. a wrong or defective light).

The buyer must return the goods within 14 days after submitting the application or provide proof that he has handed over the goods to the carrier of the goods within the aforementioned period.
Returned products must be unused, undamaged and in their original packaging. The e-shop will refund the purchase expenses in full within 14 days after receiving the products and fixing their condition. The e-shop may refuse to issue refunds until the item(s) subject to the contract have been returned or until the buyer has provided evidence that they have returned the item(s), whichever occurs first.
The e-shop does not compensate the customer for the additional cost of returning the goods.
The e-shop has the right to withdraw from the sales transaction and demand the return of the goods from the buyer if the price of the goods in the e-shop is marked significantly below the market price of the goods due to an error.

RIGHT TO MAKE A CLAIM

The e-shop is responsible for the non-compliance of the goods sold to the buyer with the contract conditions or a defect that already existed at the time of handing over the item and that appears within up to two years from the handing over of the goods to the buyer. It is assumed that the defect already existed at the time of handing over the thing to the buyer during the first year. It is the responsibility of the E-shop to refute the corresponding assumption.
The buyer has the right to contact the E-shop within two months at the latest if a defect appears, by sending an e-mail to the address info@brightenova.com.


The e-shop is not responsible for defects that have arisen after the delivery of the goods due to the consumer's actions or inaction (incorrect use, accident, etc.) or if it is normal wear and tear due to normal use of the item.
If the goods purchased from the E-shop have defects for which the E-shop is responsible, the E-shop will repair or replace the defective goods.
If the goods cannot be repaired or replaced, the E-shop will return to the buyer all fees associated with the sales contract.
The e-shop responds to the consumer's complaint in writing or in a form that enables written reproduction within 15 days.

SOLVING ARGUMENTS

If the buyer has claims regarding the E-shop, they must be sent to the e-mail address info@brightenova.com.

If the buyer and the E-shop cannot resolve the dispute by agreement, the buyer can appeal to the Consumer Disputes Committee.
The competence of the Consumer Disputes Committee is to resolve disputes arising from the contract concluded between the buyer and the E-shop. Review of the buyer's complaint by the commission is free of charge.

The buyer can turn to the platform for resolving consumer disputes of the European Union.
